Terms of use of the Museum Card

The terms are valid from April 11, 2023

These terms of use regulate the purchase of the Museum Card (including the Gift Card) by the buyer on the website www.muuseumikaart.ee or at the place of visit, and the provision of the Museum Card service by SA Muuseumikaart to the user and the rights and obligations between the parties. These terms of use do not apply if the Gift Card is purchased from a reseller.

The buyer and user confirm that before purchasing and/or using the Museum Card or gift card they have read the terms of use, understand the content, and agree with these.

Buyers and users under the age of 18 confirm that for the purchase of the Museum Card or Gift Card or for the use of the Museum Card they have used the funds given to them for this purpose or for free use by their legal representative or a third party with the consent of the latter.

If the buyer purchases the Museum Card for someone else (the user), the buyer ensures that they have introduced the terms of use to the user. The terms of use are available on the website www.muuseumikaart.ee, where they are available for download.

  1. Meanings

Terms of use are the present terms of use that regulate the purchase and use of the Museum Card.

The Museum Card or the Museum Card Service is a service that allows the user to visit the places of visit allowed to the members of the Museum Card according to the procedure stipulated in the terms of use without purchasing a ticket for each place of visit. The term “Museum Card” also refers to the item proving the purchase of the Museum Card service (if the service provider has made it available) or the virtual identifier (code displayed on the mobile application etc.), issued to the user by the service provider.

The Gift Card is a gift card (or a corresponding token) that the user can exchange for the Museum Card.

SA Muuseumikaart or the service provider is a legal entity providing the Museum Card service.

The Museum Card’s User or the user is a natural person who has the right to use the Museum Card.

The buyer is a natural or legal person who has purchased the Museum Card or Gift Card. The buyer may or may not be the user.

The member of the Museum Card is a legal entity (organization/museum) that has signed a membership agreement with SA Muuseumikaart, and whose places of visit (museums) are specified in the membership agreement and that the user can visit. Members of the Museum Card may change over time and the list is available online at www.muuseumikaart.ee/muuseumid.

The place of visit is a building or part of it, a complex, an area, a vehicle, or any other object managed by the member of the Museum Card that is intended to be visited, generally for a fee, and that is covered by the Museum Card service. Places of visit may change over time, and the list is available online at www.muuseumikaart.ee/muuseumid.

  1. The rights related to the Museum Card

The Museum Card is personal and can only be used by the user. The user does not have the right to transfer the Museum Card or its right of use to third persons.

The Museum Card can be digital in the form of a QR code and is linked to the user’s personal ID.

During its validity the Museum Card gives the user access to the places of visit under the terms and to the extent stipulated in the terms of use.

The user understands that although the service provider makes reasonable efforts to ensure that the list of places of visit remains unchanged or is complemented that the service provider cannot guarantee that and the list of places of visit and members of the Museum Card may change over time, meaning also that cooperation with some places of visit or members of the Museum Card may end (incl. during the validity period of the user’s Museum Card). Changes to the list of places of visit or the members of the Museum Card are not considered a breach of agreement and do not constitute a basis for claiming damage or other compensation from the service provider.

  1. Access to the place of visit

In order to enter the place of visit with the Museum Card, the visit must be checked in at the place of visit’s ticket office.

The place of visit registers every visit of the user of the Museum Card.

Access is secured only with a valid Museum Card.

At the request of the place of visit the user is obliged to prove their identity. If the user is unable to prove their identity, the place of visit may refuse to allow visiting on the basis of the Museum Card and ask to purchase a regular museum pass. The service provider will not reimburse the user for the cost of such museum passes that were are purchased due to the user’s inability to identify themselves.

With the Museum Card access is free of charge to permanent and temporary exhibitions available with the regular museum pass. For events with special prices and certain temporary exhibitions, for which the place of visit has made a relevant public announcement, an additional fee may be applied.

The place of visit has the right to charge a reservation fee if the user of the Museum Card books their visiting time in advance.

The total number of visits during the period of validity of the Museum Card is not limited but only one visit per day can be registered in each place of visit.

The service provider of the Museum Card is not a provider of museum services and is not responsible for any circumstances related to the place of visit (including but not limited to opening and closing times; the quality, duration, changes, cancellation of exhibitions or events; accessibility; internal rules; etc.). The user undertakes to make sure the place of visit is suitable to them before going there and to follow good conduct, internal rules of the place of visit, and legal regulations.

  1. Purchase of the Museum Card and Gift Card

The Museum Card and Gift Card can be purchased on the website www.muuseumikaart.ee and at the ticket office of certain places of visit. The Gift Card can also be purchased from resellers but in such case the reseller’s terms apply to the purchase.

Before purchasing the Museum Card or Gift Card, the service provider or the place of visit informs the buyer about the total cost and available payment methods.

Confirmation of the purchase of the Museum Card or Gift Card is sent to the e-mail address specified by the buyer. If the buyer does not receive a confirmation letter about the purchase within one hour after making the purchase, the buyer must contact the service provider at info@muuseumikaart.ee.

The purchased Gift Card must be exchanged for the Museum Card within the period indicated on the Gift Card, which is generally 12 months after the purchase. It is possible to exchange the Gift Card for the Museum Card on the website www.muuseumikaart.ee and in certain places of visit. When exchanging the Gift Card for the Museum Card on the website www.muuseumikaart.ee, you must select “Gift Card” as the payment method for the Museum Card. If the Gift Card is not exchanged for the Museum Card within the period indicated on the Gift Card, it will lose its validity and it will no longer be possible to exchange it for the Museum Card.

The Museum Card or Gift Card cannot be partially used or exchanged for money or other benefits.

  1. Validity of the Museum Card

The Museum Card becomes valid on (i) the first visit to a place of visit or (ii) on the 180th day after the purchase of the Museum Card, whichever is earlier.

If the Museum Card has not been used in any place of visit the service provider will send a reminder to the buyer 30 days before the 180th day. On the 180th day the notice will be sent that the Museum Card becomes valid from that day although no visits were made so far.

The Museum Card is valid for 12 months from activation if it has not been renewed.

The validity of the Museum Card can be checked by registering at the place of visit, on the service provider’s website (if enabled by the service provider), or by contacting the service provider at info@muuseumikaart.ee.

It is not possible to suspend the validity of the Museum Card temporarily or permanently.

  1. Processing of personal data

During the purchase and use of the Museum Card and Gift Card, the buyer’s and user’s personal data is processed. More details about the processing of personal data are stipulated in the privacy policy of SA Muuseumikaart, which is available at www.muuseumikaart.ee/privaatsus.

  1. Right of withdrawal

It is possible to return the Museum Card and Gift Card purchased from the website www.muuseumikaart.ee (i.e. withdraw from the agreement) in accordance with the law within 14 days from the moment of purchase. In order to return the Museum Card or Gift Card, you must submit a request to the service provider at info@muuseumikaart.ee together with the purchase document within 14 days from purchase. The user understands and confirms they are aware that the Museum Card purchased from the website www.muuseumikaart.ee cannot be returned (withdrawn from the agreement) if it has been used even once at any place of visit.

The user understands and confirms they are aware that the Gift Card purchased from the website www.muuseumikaart.ee cannot be returned (withdrawn from the agreement) if it has already been exchanged for the Museum Card.

In the case of a withdrawal from the agreement the service provider returns all received payments to the buyer within 14 days from the day the service provider became aware of the buyer’s decision to withdraw from the agreement. The service provider makes the refund using the same payment method and the same payment data that the buyer used to make the payment unless the service provider and the user expressly agree otherwise.

It is not possible to return (withdraw from the agreement) the Museum Card or Gift Card purchased at a place of visit.

  1. Changing the terms of use

The service provider has the right to change the terms of use unilaterally if it is necessary due to changes in the content of the service, or legislation or in order to ensure compliance of its activities with any regulations, court rulings, etc.

The service provider publishes the amended terms of use on its website www.muuseumikaart.ee and informs all users of the valid Museum Card about it also by e-mail.

The changes take effect from the publication of the amended terms of use and/or notifying the users or at another time specified in the amended terms of use.

Any changes in the places of visit covered by the Museum Card (including but not limited to their opening and closing times; quality, duration, changes, cancellation of exhibitions or events; accessibility; internal rules; etc.) are not considered a change to the terms of use.

  1. Final provisions

The service provider has the right to temporarily suspend the provision of the service if it is necessary due to an update or failure of the service or technical software, or if it is obliged to do so due to the law, court ruling, regulations, etc. The service provider will do everything reasonably possible to inform the users of the suspension in advance, and to ensure that the interruption does not last unnecessarily long and that the resulting inconvenience is minimal.

The service provider has the right to suspend the user’s right to use the service if there is reason to suspect that the user is violating the terms of use or otherwise behaves dishonestly or unlawfully.

The user has the right to use all legal remedies prescribed by law.

The service provider is not responsible for any circumstances or damage related to the place of visits (including, but not limited to, their opening and closing times; the quality, duration, changing, cancellation, etc. of exhibitions or events; accessibility; internal rules; etc.).

The service provider’s liability is limited to the maximum extent permitted by applicable law. The financial liability of the service provider is limited to the cost of the Museum Card. The exclusion and limitation of liability do not apply if the death of the user is caused or their health is damaged as well as in other cases when the damage is caused intentionally or due to gross negligence.

If any part of the terms of use is void or not considered a part of the agreement the rest of the terms of use will apply.

The service provider has the right to transfer the rights and obligations arising from the terms of use to a third party without the consent of the user provided that the probability of fulfilling the terms of use does not decrease as a result.

The user has the right to stop using the Museum Card at any time and the service provider has the right to stop offering the Museum Card service at any time but the service provider will not reimburse the full or partial cost of the Museum Card in such case.

The laws of the Republic of Estonia apply to the terms of use. The United Nations Convention on agreements for the international sale of goods does not apply to the terms of use.

The parties will try to resolve all disputes related to the terms of use through negotiations. If the parties fail to resolve disputes through negotiations they have the right to appeal to the court.

In addition, the buyer and user as consumers can file a complaint with the Consumer Disputes Committee operating at the Consumer Protection and Technical Regulatory Authority, whose competence is to resolve disputes arising from the agreement concluded between the buyer and the seller, which the parties have not been able to resolve by negotiations, provided that the value of the disputed product or service is 20 or more euros. The terms of use are written in Estonian. If the service provider makes the terms of use available in other languages the Estonian terms of use shall rule in case of inconsistencies between Estonian and translation.
